Home Ownership After Foreclosure, Short Sale, Bankruptcy; When Can I Buy Again?

"DREAM" IT'S THE AMERICAN WAY!

I had my chance; they aren't going to give me another one, or will they?

Yes they will, it's just a matter of when!

WAITING PERIOD (Your time to rebuild)

FORECLOSURE: If you have a "Foreclosure" looming on your credit your "time to rebuild" is 3 years!

SHORT SALE: If you sold your home in a "Short Sale" you have 2 years to rebuild if your payments were delinquent. If you were not delinquent in your payments, your time is now!

BANKRUPTCY: With a "Bankruptcy" you have 4 years to rebuild unless it was a Chapter 13 (reorganization) in which case you have 3 years to rebuild.

DEED IN LIEU OF FORECLOSURE: With a "Deed in Lieu of foreclosure" you will have 4 years to rebuild and possibly only 2 if there are extenuating circumstances.

Certainly not as bleak as many of us would have believed!

Begin your process by holding on to your job, cleaning up your debt to income ratio and banking for a down payment. Your dream really can come true and I will be here to help you through, answering questions and pointing you to the right professionals to help you gain that pre-approval!

PLEASE READ FOR THE MOST CURRENT CHANGES...

Advising Foreclosure, Short Sale and Deed-in-Lieu Clients

If you are working with a client who has had a short sale or a deed-in-lieu in their past, or you are listing a home and your sellers may have the same issues, FannieMae announced new waiting periods, as of July 1, 2010, before being eligible for another loan. The waiting period is defined as "from the date of the pre-foreclosure to the date of application". These policies favor borrowers that work with their servicers to avoid Full Foreclosure either by Deed-in-Lieu, Pre-foreclosure Sale, or Short Sale.

· Fannie defines ALL Pre-foreclosures as any one of the following three event types:

o Deed-in-Lieu

o Preforeclosure Sale

o Short Sale

· Full Foreclosure - Current applications wait 5 yrs;

As of applications dated October 1, 2010 - 7 yrs

New Waiting Periods Effective for July 1, 2010 Applications

Waiting Periods for Other Derogatory Events

Ever wonder how long your clients have to wait to apply for another loan after they've filed Bankruptcy? Here are the rules, so you can advise prospect/clients and not waste your time if they don't meet these requirements!

What's an "Extenuating Circumstance"? If your clients had a job loss, major medical bills, an accident, etc., then they don't have to wait as long. However, documentation is critical, as clients have to PROVE they had financial difficulties BEYOND their control.

Lets face it every now and then we just crave Chinese Food!

I know I do! I love the little boxes of my personal comfort food I can eat just about anywhere!

I have tried them all more than once and have found China Garden in Dayville, CT to be my favorite!

The staff is friendly and the food is consistently great! I mainly like it for take out but they do have a dining area if you wish. I have met friends there several times for lunch and haven't found one yet that didn't get hooked on the tasteful quality. The more people I talk to and ask where they get their Chinese Food fix from tell me China Garden is the best in Killingly!

Have you wondered, as I have, where to turn to have your clothes altered?

If you're anything like me your waist just can't decide where it wants to be!

I have tons of clothes that used to fit in both directions. I have big clothes, I don't ever want to fit into again, my super skinny clothes from partying like a teenager after my divorce and I have my so so clothes I tolerate when the few things that fit nicely are in the wash!

SO WHATS A WOMAN TO DO?

Well, I took advice from TLC's "What Not To Wear"!

I bought some new clothes, that I can never seem to buy to fit, and called Carol.

That's right, I'm biting the dust and getting over the "I'm not going to buy brand new clothes and then spend more money to fix them"! I know all the reasons why not, I've been using them for years - There has to be clothes I can just buy, wear and feel great in - I will lose 5 pounds and then this will fit perfect - Who cares what I look like after all it's not about the look it's about my wonderful personality RIGHT!

Wrong, it's about how I feel before I encounter "YOU", the world, my family, my friends... It's about the me in the mirror, the woman trapped inside that no matter how hard I try, just won't SHUT UP! She deserves to smile at what she sees looking back at her in more ways than just how WONDERFUL she knows she is!

Let me introduce you to Carol!

Carol has been brightening woman's lives now for over 14 years. She's as sunny and cheerful as her establishment on North Main Street in Danielson. She is located directly across the street from Bills Bedding in an old Victorian Style Home built in 1880. The decor shows Carols eye for color and detail.

My fiance, Jeffrey Decker built a beautiful bar in my home and wanted everything to be perfect. When we set out to buy bar stools we had a hard time finding a perfect fit. This is when we found Carol's business. We found stools with the perfect structure but didn't care for the upholstery. Having tried Sushi for the first time about 7 years ago in Times Square, and getting quite ill, I counted myself among the non-sushi consumers; 85 Main changed that for me this year!

My fiance loves Sushi so for him we would stop in and I would ask, how can you eat that stuff! It took me several visits and an apple martini to get daring enough to give it a try again. Now I'm the one asking "when are we going to 85 Main for Sushi again"?

They have expanded the bar area which now includes a Raw Bar on one end and the Sushi Bar on the other. You can enjoy steamers, muscles, shrimp cocktail, oysters and so much more all served by a fabulous group of individuals! The atmosphere is casual fine dining and it's one of my new favorite places to dine. Give it a try and you'll be glad you did!

Tax Credit Extension of Closing Date: Did it pass or not?

There seems to be a lot of confusion whether or not this this bill was passed into law.

I hope this will clear things up for so many wanting a definitive answer.

Becoming Law Requires more than just passing the Senate.

The Tax Extenders Bill was amended and this amendment was passed by the Senate allowing an extension of time to close until September 30, 2010.

So what happens next?

In order for this extension to become law the entire "Reconstructed Tax Extenders Bill" needs to be approved by the "House of Representatives".

Where does that leave all the First Time Homebuyers currently under contract and scurrying to close by June 30th? A bit up in the air but with a little more hope that it will all work out!

The Senate Finance Committee, chaired by Senator Max Baucus, was forced by a "Point of Order" vote to reconstruct the overall proposal before another vote can be taken. Providing the amendments are constructed properly, there is hope of the Senates approval and for the bill to move forward to the House of Representatives to become law extending the Closing Date Deadline to September 30, 2010.

I will be keeping a close eye on the progress and update as more information becomes available.

Are Well & Septic Distance Issues Stalling Your Closing?

FHA Guidelines have changed; are you up to speed?

It seems most involved in a Real Estate Transaction are not!

100 Feet is the new minimum! If you're under do you know what needs to be done?

Lenders will tell you they can offer a waiver but don't buy it! They have their own rules and they are sometimes more stringent than HUD!

BUYER'S:

Does your Realtor know how to protect your "Hard Earned Money"?

Take it from me it's not easy when the Lender changes the rules in the home stretch!

Do your septic inspection first and if you are under 75 feet do not spend another dime until your lender sends the package to HUD for a waiver. Do not take no for an answer. Do not let your lender tell you they will waive it for you. Do not trust this! They are known to change their mind in the last hours and delay your closing if it ever happens at all. Once you have spent that Home Inspection Money, there is no way to get it back!

Let the seller pay for the water test that will be needed as part of the determination to waive. You may have to reimburse if it's waived but if it's denied why should it cost you. If the seller's property doesn't meet current code and doesn't qualify for a waiver why should you be out? It's simple, you shouldn't!
